NETATMO (SAS) et, le cas échéant, ses affiliés (collectivement dénommés ‘NETATMO’, ‘nous’, ‘nos/notre’) fabrique, distribue et vend des produits électroniques de consommation NETATMO (le ‘Produit’).

Nous proposons également (a) un site Internet accessible à l’adresse suivante www.netatmo.com et plus généralement, tous les sites web et URL gérés par NETATMO ou relevant du domaine netatmo.com (le ‘Site’), (b) des services disponibles sur le Site et/ou à travers le Site (les ‘Services du Site’), (c) certains logiciels pouvant être téléchargés sur votre ordinateur (le ‘Logiciel d’ordinateur’), et (d) certains logiciels pouvant être téléchargés sur votre appareil mobile (le ‘Logiciel Mobile’). Dans le présent texte, le terme ‘Logiciel’ fait référence au Logiciel d’ordinateur et au Logiciel Mobile ; le terme ‘Site’ signifie le Site, les Services du Site, le Logiciel d’ordinateur et le Logiciel Mobile. Les termes ‘vous’, ‘vos/votre’ ou ‘utilisateur’ désignent tous les individus et les entités accédant à et/ou utilisant nos Services, le terme 'Services' désigne le Produit, les applications mobiles et de l’internet ainsi que le Site. Les présentes Conditions d’Utilisation régissent votre accès aux Services et à l’utilisation que vous en faites.

ACCEPTATION DES CONDITIONS D’UTILISATION

• Les présentes Conditions d’Utilisation ainsi que la Politique de Confidentialité, disponibles sur https://www.netatmo.com (la ‘Politique de Confidentialité’) régissent votre accès aux Services et l’utilisation que vous en faites. Veuillez LES LIRE ATTENTIVEMENT.
• En vous inscrivant volontairement sur le Site, en accédant et/ou en utilisant tout ou partie des Services, vous reconnaissez avoir lu, compris et accepté les termes des présentes Conditions d’Utilisation et la Politique de Confidentialité. Si vous n’acceptez pas ces dernières, veuillez ne pas utiliser ces Services, ni y accéder ou y naviguer.
• Nous pouvons modifier ces Conditions d’Utilisation dans le cadre de la mise à disposition de nouveaux Services, d’évolution de la réglementation, suite à la demande des autorités légales, ou amendées pour en améliorer la compréhension. Vous pouvez accéder sur le Site à la version la plus récente de ces Conditions d’Utilisation. UTILISATION DES SERVICES

• Les Services peuvent être utilisés par des utilisateurs de plus de 16 ans. L’utilisation de nos Services par des utilisateurs de moins de 16 ans est interdite, sauf autorisation d’un parent ou d’un tuteur. En vous enregistrant, en accédant et en utilisant nos Services, vous reconnaissez que les informations fournies, y compris celles relatives à votre âge ou au consentement d’un parent ou d'un tuteur, sont véridiques et complètes.
• Les Services contiennent toute sorte d’informations et d’éléments, y compris, sans s’y limiter, logiciels, textes, graphiques, communications, mesures, tests, résultats, opinions, photographies, dessins, profils, messages, notes, liens de site internet, musique, vidéos et tout autre image animée ou non, conceptions, fichiers musicaux, audio ou autre, comptes rendus, tableaux, données, et tout autre contenu, détenus par NETATMO ou cédés sous licence par NETATMO à un tiers, y compris les autres utilisateurs des Services, à l’exclusion des Contenus Générés par les Utilisateurs, ci-dessous définis (collectivement désignés sous le terme de ‘Contenu’).
• Les Services et le Contenu sont protégés par les dispositions du code de la Propriété Intellectuelle française et toute autre loi ou réglementation applicable. Vous reconnaissez et acceptez que NETATMO (ou ses concédants) possède tous les droits, titres et intérêts légaux sur les Services et le Contenu, y compris les droits de propriété intellectuelle couvrant les Services et le Contenu (que ces droits aient été enregistrés ou non, et quel que soit l’endroit dans le monde où existent ces droits). Vous reconnaissez également que ces Services peuvent contenir des informations considérées comme étant confidentielles par NETATMO et vous vous engagez à ne pas diffuser ces informations sans l’accord préalable écrit de NETATMO.
• NETATMO vous concède une licence personnelle, mondiale, gratuite, non transférable et non exclusive pour utiliser son Contenu, dans le cadre de ses Services. Cette licence vous est fournie dans le seul but de vous permettre d’utiliser et de bénéficier pleinement du/des Produit(s) que vous avez enregistré(s) sur le Site, aussi longtemps que vous aurez le droit d’être enregistré, d’accéder ou d’utiliser les Services, dans le cadre défini par ces Conditions d’Utilisation. Vous n’êtes pas autorisé à (et vous ne devez pas permettre à quiconque de) copier, reproduire, modifier, traduire, diffuser, présenter ou afficher en public, distribuer, transférer, créer un encart, rééditer, télécharger, afficher, présenter, poster, transmettre, vendre, commercialiser, créer des œuvres dérivées, rétro-concevoir, décompiler ou tenter par tout autre moyen d’extraire de quelque manière que ce soit le code des Services et du Contenu, sauf accord exprès et écrit de NETATMO. Vous acceptez de ne pas avoir recours à l’exploration de données, aux robots, à la récupération de données ou à toute autre méthode d’extraction similaire.
• Aucune autre utilisation de nos Services et Contenu n’est autorisée sans l'accord exprès et préalable de NETATMO. Vous devez conserver toutes les mentions de droits d’auteur et de propriété figurant dans le Contenu d’origine sur toute reproduction du Contenu.
• Toutes les marques, logos, noms de domaine et autres éléments identifiants de NETATMO (la ‘Marque NETATMO’), utilisés et affichés dans les Services, appartiennent à ou sont valablement détenus par NETATMO. Tous les autres noms de produits et de prestations de service mentionnés dans les Services peuvent être des marques appartenant à des tiers (les ‘Marques des Tiers’ et collectivement avec la Marque NETATMO, les ‘Marques’). A l’exception des licences et des droits expressément conférés par les présentes Conditions d’Utilisation, rien de ce qui est contenu dans ces Services, Contenu ou Conditions d’Utilisation ne peut être interprété comme conférant une quelconque licence ou un quelconque droit d’utiliser une Marque sans l'autorisation préalable et écrite de NETATMO. Les Marques ne peuvent pas être utilisées pour dénigrer ou nuire à la notoriété de NETATMO ou de tout tiers, aux produits et aux services de NETATMO ou de tout tiers, de quelque manière que ce soit. Vous ne pouvez pas utiliser les Marques pour illustrer un lien ou un site internet sans le consentement écrit de NETATMO. Toute survaleur générée par l’utilisation de la ou des Marque(s) NETATMO sera au profit de NETATMO.
• Vous acceptez de ne pas : (a) effectuer une opération imposant un charge déraisonnable à l’infrastructure des Services, (b) utiliser un dispositif, un logiciel ou un programme pour nuire ou tenter de nuire au bon fonctionnement des Services ou de toute activité menée sur les Services, (c) tenter de déchiffrer, de décompiler, de désassembler ou d’effectuer une rétro-conception sur n’importe quel logiciel comprenant ou constituant ces Services, (d) supprimer ou modifier des informations affichées sur ce Site par NETATMO ou par toute personne ou entité, et/ou (e) insérer un encart (inclusion) ou créer un lien hypertexte avec tout élément ou information disponible sur les Services.
• Certains éléments de nos Services sont protégés par les lois sur l’emballage, sur les marques, sur la concurrence déloyale et d’autres lois, et ne peuvent être copiés ou imités, en tout ou en partie, d’aucune façon, y compris, sans s’y limiter, la technique d’inclusion ou de mirroring, à l’exception des dispositions expressément spécifiées à l’article 2.4 des présentes Conditions d’Utilisation. La retransmission du Contenu et des Services n’est pas autorisée, sauf accord exprès préalable et écrit de NETATMO, à redemander à chaque fois.
• Si vous jugez en toute bonne foi que les éléments des Services fournis par NETATMO enfreignent vos droits d’auteur, vous (ou votre agent) pouvez nous faire parvenir un avis écrit nous demandant de retirer ledit élément ou d’en bloquer l’accès. Les avis et contre-avis relatifs aux Services doivent être envoyés à NETATMO :

CONTENU GENERE PAR LES UTILISATEURS

Les articles de ce paragraphe concernent le Contenu Généré par les Utilisateurs (le « CGU ») sans avoir été sollicité par NETATMO et non relatif au contenu auquel NETATMO a accès dans le cadre de l’utilisation des produits et des services associés, pour lequel les articles de la Politique de Confidentialité s’appliquent.

Le CGU comprend tout type d’informations et d’éléments, y compris, sans s’y limiter, votre nom, vos informations biographiques, et tous autres noms, noms d’utilisateurs, pseudonymes, logiciels, textes, graphiques, communications, mesures, tests, résultats, opinions, photographies, dessins, profils, messages, notes, liens internet, musique, fichiers vidéo ou toute autre image animée ou non animée, conceptions, fichiers musicaux, audio ou autres, comptes rendus, tableaux et données, et tout autre contenu, y compris les observations et les commentaires, tels que ci-dessous définis, que vous publiez, affichez, transmettez, dévoilez, transférez, stockez, partagez ou que vous rendez disponible (que vous ‘postez’) sur les Services ou sur le Site.

• En publiant, affichant, transmettant, dévoilant, transférant, stockant, partageant, ‘postant’ ou rendant disponible votre CGU sur les Services, le Site, ou par leur entremise, vous accordez à NETATMO une licence perpétuelle, irrévocable, non exclusive, mondiale et gratuite, assortie du droit d’accorder une sous-licence, de copier, reproduire, modifier, traduire, diffuser, produire, afficher, distribuer, transmettre, créer un encart, rééditer, télécharger, afficher, présenter, poster, vendre, commercialiser, exploiter commercialement, créer des œuvres dérivées, rétro concevoir, décompiler, extraire un code sur votre CGU par tout moyen déjà existant ou à venir, y compris, sans s’y limiter, sur des sites internet, des supports papier et audio. Vous renoncez par la présente à tous droits moraux et droits similaires relatifs au CGU, et de toutes autres prérogatives légales qui empêcheraient NETATMO d’utiliser le CGU ou obligeraient NETATMO à vous demander l’autorisation d’utiliser le CGU, sauf dispositions d'ordre public. Vous renoncez expressément à toute action ou réclamation à l’encontre de NETATMO ou de ses sous-licenciés, liée à l’utilisation par NETATMO ou ses sous-licenciés du CGU, et vous garantissez NETATMO et ses sous-licenciés de toute action ou réclamation de tiers.
• Vous déclarez que votre CGU : (i) ne porte pas atteinte aux droits de tiers, dont les droits de propriété intellectuelle d’un tiers, qu’il s’agisse de droits d’auteur, de brevets, de marques commerciales, le droit à la vie privée, la protection des secrets commerciaux ou de tout autre droit; (ii) ne peut pas être considéré comme obscène et ne contiendra pas de pornographie juvénile ; (iii) ne contient pas de virus, de vers informatiques, de bombes logicielles ou tout autre code de programmation informatique destinés à endommager, à interférer, à intercepter ou à éliminer tout système, donnée ou information ; et (iv) est précis, exact, sincère, complet, non trompeur et ne porte pas atteinte ou ne viole pas les lois et règlements applicables. Vous êtes tenus de vous conformer à toutes les lois applicables à votre CGU.
• Vous déclarez être conscient que le contenu des CGU est public et non confidentiel.
• En cas de non-respect des présentes conditions, Nous nous réservons le droit de suspendre votre droit d’utilisation des Services et/ou du Site, à titre temporaire ou permanent, outre la possibilité de vous demander l’indemnisation de toute perte ou dommage qui pourraient être subis.

PUBLICITE, LIENS ET INCLUSIONS

Le Site et les logiciels peuvent contenir des informations, des liens et/ou des publicités relatifs à d’autres sites internet exploités par des tiers (les ‘Sites administrés par des Tiers’). En outre, les emails envoyés par les utilisateurs des Services peuvent contenir des informations, des liens et/ou des publicités pour des Sites administrés par des Tiers. Les informations, les liens et les publicités relatifs à des Sites administrés par des Tiers sont fournis à votre seule convenance. Nous n’exerçons aucun contrôle sur les Sites administrés par des Tiers et ne sommes pas responsables du contenu et des pratiques de ces Sites administrés par des Tiers et/ou des opérations effectuées avec les opérateurs de ces Sites administrés par des Tiers.
NETATMO vous recommande de lire attentivement les conditions d’utilisation et la politique de confidentialité (le cas échéant) applicables aux Sites administrés par des Tiers. Vous reconnaissez et acceptez que NETATMO ne peut pas être tenu responsable du contenu des Sites administrés par des Tiers, des sites hébergés sur le Site ou de la publicité des tiers sur le Site et/ou des emails envoyés à partir de ce Site ; NETATMO ne fournit aucune garantie quant à leur contenu ou leur exactitude. L’utilisation de Sites administrés par des Tiers est à vos risques, et assujettis aux termes et aux conditions d’utilisation de ces sites.

IDEES NON SOLLICITEES ET COMMENTAIRES

• NETATMO est sensible à l’intérêt que vous portez à nos produits et à notre société, et comprend que vous ayez des commentaires et des suggestions. Cependant, NETATMO ne souhaite pas que vous envoyiez, et vous ne devriez pas envoyer, des informations de nature confidentielle ou protégée à NETATMO par l’intermédiaire de ses Services ou de tout autre moyen. Veuillez noter que vous n’êtes pas lié à NETATMO par un accord de confidentialité et que les informations ou les éléments non sollicités que vous enverrez à NETATMO ne seront pas considérés par NETATMO comme des informations de nature confidentielle ou protégée. Vous pouvez consulter un avocat avant d’envoyer à NETATMO une quelconque proposition non sollicitée, de façon à comprendre les conséquences découlant de l’envoi à NETATMO de ces propositions publiques non sollicitées. • Après avoir remis vos Commentaires, vous (1) garantissez que vous êtes le concepteur ou le développeur original des Commentaires, que vous êtes légalement apte à faire une telle divulgation, que vous serez entièrement tenu responsable des dommages résultant de la divulgation d’informations protégées par les droits d’auteur, secret commercial, brevet ou tout autre droit de propriété et (2) comprenez notre politique relative aux Commentaires énoncée dans le présent Article et acceptez ladite politique sans réserve.

POLITIQUE DES OBSERVATIONS

• Les Services vous offrent la possibilité de poster publiquement des commentaires, des articles et toute autre observation (collectivement les ‘Observations’). En postant et/ou en fournissant des Observations aux Services, vous comprenez pleinement et acceptez l’octroi des droits décrits à l’article 5 ci-dessus. Vous autorisez également tous les utilisateurs d’accéder, d’afficher, de voir, de stocker et de reproduire ces Observations à des fins personnelles. Vous reconnaissez que, dans la mesure où vous fournissez des renseignements personnels d’identification dans vos Observations, il nous est permis de reproduire ces informations. NETATMO se réserve le droit de modifier et de publier ces Observations ou le droit de refuser, d’accepter, de poster, de diffuser ou de transmettre l’une quelconque de ces Observations, à sa seule discrétion.
• Bien que NETATMO n’ait pas l’obligation de contrôler les Observations, vous reconnaissez et acceptez que nous puissions appliquer l’une ou toutes les mesures suivantes : (i) contrôler les Observations ; (ii) modifier, publier ou retirer une quelconque Observation, en totalité ou en partie ; (iii) rendre publique l’une de ces Observations. Les Observations postées sur le Site par les utilisateurs n’impliquent aucunement une adhésion ou une approbation desdites Observations de la part de NETATMO. NETATMO ne peut être tenu pour responsable et décline toute responsabilité découlant des Observations.
• Vous acceptez d’être tenu responsable de l’utilisation que vous faites des Services, des Observations que vous soumettez et des conséquences en découlant. Vous acceptez d’utiliser les Services conformément à toutes les lois locales, fédérales, nationales et internationales, règles et règlements applicables, y compris les lois relatives à la diffusion des données techniques en provenance de votre pays de résidence. Si vous souhaitez créer un forum où partager vos idées dans un environnement protecteur et productif, vous acceptez de NE PAS :
  • Poster des informations d’ordre privé, récolter, collecter ou divulguer des informations concernant un tiers sans son consentement exprès;
  • Poster des contenus sur le Site de teneur illégale, raciste, haineuse, injurieuse, diffamatoire, obscène, intentionnellement discriminatoire ou menaçante vis-à-vis de certains individus ou groupes d’individus;

  • Usurper l’identité de personnes physiques ou morales, y compris d’employés de NETATMO, présenter de manière inexacte ou délibérément erronée vos rapports avec telle ou telle personne physique ou morale;
  • Insinuer que NETATMO avalise vos déclarations ou vos positions;
  • Prendre des mesures qui imposeraient une charge déraisonnable à notre serveur;
  • Utiliser un dispositif, un logiciel ou un programme pour nuire ou tenter de nuire au bon fonctionnement des Services ou d’une quelconque activité menée sur les Services;
  • Tenter de déchiffrer, de décompiler, de désassembler ou d’effectuer une rétro-conception sur n’importe quel logiciel comprenant ou constituant ces Services ; et/ou
  • Effacer ou modifier des éléments postés par toute autre personne physique ou morale.

EXCLUSION DU CONTENU ET GARANTIES

• La garantie du Produit figure à l’annexe ‘Garantie Limitée’ disponible sur https://www.netatmo.com .
• NETATMO, SES AFFILIES, SES ADMINISTRATEURS, DIRIGEANTS, EMPLOYES, AGENTS, FOURNISSEURS OU CONCEDANTS RESPECTIFS (COLLECTIVEMENT DENOMMES LES ‘PARTIES NETATMO’) NE PEUVENT EN AUCUN CAS ETRE TENUS RESPONSABLES ET NE FONT AUCUNE DECLARATION, DE NATURE EXPRESSE OU IMPLICITE, A L’EGARD DU CONTENU ET DES SERVICES, Y COMPRIS, LE FONCTIONNEMENT, L’EXACTITUDE, LA FIABILITE, L’EXHAUSTIVITE, L’ACTUALITE OU LA PRECISION. LES PARTIES NETATMO NE GARANTISSENT PAS QUE LES SERVICES NE CONTIENNENT AUCUNE ERREUR, QU’ILS SERONT ACCESSIBLES SANS INTERRUPTION, A TOUT MOMENT, DE N’IMPORTE QUEL ENDROIT, OU QUE LES SERVICES, SON SERVEUR, SON CONTENU, SONT EXEMPTS DE TOUT VIRUS INFORMATIQUE, DE CONTAMINATION SIMILAIRE OU DE CARACTERISTIQUES DESTRUCTIVES. SI L’UTILISATION QUE VOUS FAITES DES SERVICES OU DE SON CONTENU ENGENDRE LA NECESSITE DE REPARER OU DE REMPLACER L’EQUIPEMENT OU LES DONNEES, LES PARTIES NETATMO NE DEVRONT EN AUCUN CAS EN SUPPORTER LES COUTS. LES PARTIES NETATMO EXCLUENT TOUTE RESPONSABILITE, Y COMPRIS, MAIS SANS S’Y LIMITER, LA GARANTIE DE BON DROIT, DE QUALITE MARCHANDE, DE NON VIOLATION DES DROITS DE TIERS ET D’ADEQUATION A UN USAGE PARTICULIER.
• Le Contenu des Services est présenté de façon sommaire, et uniquement à titre informatif. Les données, les mesures et toute autre sorte de contenu fournis par les Services sont fournis sans aucune garantie d’exactitude et ne doivent pas être utilisés comme source d’information pour éclairer une prise de décision.

LIMITATION DE RESPONSABILITE

• EN AUCUN CAS, AUCUNE DES PARTIES NETATMO NE POURRA ETRE TENUE RESPONSABLE D’EVENTUELS DOMMAGES INDIRECTS, INCIDENTS, PUNITIFS OU CONSECUTIFS (Y COMPRIS, SANS S’Y LIMITER, LES DOMMAGES RESULTANT DE PERTE DE PROFIT, PERTE DE DONNEES OU D’INTERRUPTION D’ACTIVITE), DECOULANT DE L’UTILISATION, DE L’IMPOSSIBILITE D’UTILISATION OU DES RESULTATS DE L’UTILISATION DES SERVICES ET DE SON CONTENU, QUE CES DOMMAGES SOIENT FONDES SUR UNE GARANTIE CONTRACTUELLE OU DELICTUELLE (MEME EN CAS DE NEGLIGENCE) OU TOUTE AUTRE THEORIE LEGALE, MEME SI LES PARTIES NETATMO ONT ETE AVISEES DE LA POSSIBILITE DE TELS DOMMAGES. LES PARTIES NETATMO NE PEUVENT ETRE TENUES RESPONSABLES DE LA VERACITE, DE L’EXACTITUDE ET DE L’EXHAUSTIVITE DU CONTENU ET DES SERVICES, OU DE TOUTE AUTRE INFORMATION ACHEMINEE VERS L’UTILISATEUR, OU POUR LES FAUTES, ERREURS OU OMISSIONS, OU POUR LES DELAIS OU LES INTERRUPTIONS DES DONNEES OU POUR LE FIL D’INFORMATIONS, QUELLE QUE SOIT LA CAUSE. VOUS ACCEPTEZ QUE L’UTILISATION DES SERVICES ET DE SON CONTENU SE FASSE A VOS PROPRES RISQUES. INDEMNISATION DE NETATMO

Sur simple demande de notre part, vous vous engagez à défendre, indemniser et protéger NETATMO de toutes pertes, responsabilités, dommages et dépenses, y compris, sans s’y limiter, les frais de justice et de comptabilité raisonnables, encourus ou découlant de toute réclamation, action ou demande liée (i) à votre utilisation ou mauvaise utilisation des Services, y compris le CGU (Contenu Généré par les Utilisateurs) ; (ii) au non-respect des présentes Conditions d’Utilisation ; ou (iii) au non-respect des droits de propriété intellectuelle ou d’autres droits de tiers ou de toute loi applicable en relation avec l’utilisation des Services. NETATMO vous avisera de telle poursuite, procès ou procédure. NETATMO se réserve le droit d’assurer la défense et le contrôle exclusifs de toute question relative à cette indemnisation en vertu de cet Article. Dans ce cas, vous acceptez de coopérer avec NETATMO et de répondre à toute demande raisonnable, en vue de l’aider pour une telle défense.

RESILIATION DES SERVICES

• Les présentes Conditions d’Utilisation continueront de s’appliquer jusqu’à dénonciation par l’une des parties, comme exposé ci-dessous.
• Si vous désirez résilier l’accord légal conclu avec NETATMO, vous pouvez le faire (a) en avertissant NETATMO à tout moment à l’adresse suivante NETATMO, 245 rue du vieux Pont de Sèvres, 92100 Boulogne-Billancourt ou par email : privacy@netatmo.com et (b) en fermant vos comptes pour tous les Services que vous utilisez.
• NETATMO peut, à tout moment, mettre fin à l’accord légal conclu avec vous si :
  • Vous avez enfreint les dispositions des présentes Conditions d’Utilisation (ou avez agi d’une façon qui indique clairement que vous n’avez pas l’intention de vous conformer à ces dispositions ou que vous ne pouvez pas vous y conformer) ; ou
  • NETATMO est tenu de le faire en vertu de la loi (par exemple, si la fourniture des Services est ou devient illégale) ; ou
  • Les relations entre NETATMO et le partenaire avec lequel NETATMO vous offrent les Services ont pris fin ou le partenaire a décidé de ne plus offrir ses Services ; ou
  • NETATMO ne peut plus fournir les Services aux utilisateurs du pays dans lequel vous résidez ou depuis lequel vous utilisez les Services, par exemple dans le cas où NETATMO, à sa seule discrétion, décide que les Services ne sont plus viables commercialement.
• Vous comprenez et acceptez que certaines parties de votre CGU, telles celles apparaissant hors profil, peuvent continuer à apparaître sur tout ou partie du Site ou sur toute autre plateforme, même si votre CGU a été retiré du Site ou si votre compte a été fermé.
• Les articles 2 (Utilisation des Services), 7 (Exclusion du Contenu et Garanties), 8 (Limitation de Responsabilité), 9 (Indemnisation de NETATMO), 10 (Résiliation des Services) et 13 (Divers) resteront en vigueur même après résiliation des présentes Conditions d’Utilisation.

DU RESPECT DES LOIS APPLICABLES PAR L’UTILISATEUR

• Les services sont hébergés dans les pays suivants: France, Irlande, Allemagne, Pays-Bas, Etats Unis et Japon. Si vous accédez au Contenu ou aux Services, vous le faites à vos propres risques. Il vous incombe de vous conformer, aussi bien en France que hors de France, aux lois en vigueur.

Ce bannissement étant appliqué à l’adresse e-mail du compte concerné, il sera effectif à la fois pour le Forum et les demandes envoyées via l’Assistance.

EXONERATION DE GARANTIES

Netatmo ne garantit pas que le Forum et le contenu qui y figure seront disponibles sans erreur ou de façon ininterrompue, et le Forum ne fait aucune garantie, expresse ou implicite, concernant le contenu ou le Forum lui-même.

• You acknowledge that your UGC : (i) are not infringing any third party's rights, including copyright, patent, trademark, privacy right, trade secret, or other proprietary rights; (ii) is not obscene or containing child pornography; (iii) is not containing any viruses, worms, time bombs or other computer programming code that is intended to damage, interfere with, surreptitiously intercept or expropriate any system, data or information; (iv) is accurate, truthful, complete, not misleading and does not violate applicable laws and regulations. You are responsible for complying with all laws applicable to your UGC.
• You declare to be aware that the content of the UGC is public and not confidential.
• In case of non-compliance with these conditions, We reserve the right to suspend your right to use the Services and / or the Site, temporarily or permanently, in addition to the possibility to ask for compensation for any loss or damage that could be suffered.

ADVERTISING, LINKING AND FRAMING

The Site and Softwares may contain information about, links to and/or advertisements for web sites operated by other parties (the 'Third Party Sites'). In addition, emails sent to users of the Services may contain information about, links to and/or advertisements for Third Party Sites. You recognize and agree that NETATMO is not responsible for the content of linked Third Party Sites, sites framed within the Site or Third Party advertisements on the Site and/or in emails sent from this Site, and NETATMO does not make any representations regarding their content or accuracy. Your use of Third Party Sites is at your own risks and subject to the terms and conditions of use of such sites.

UNSOLICITED IDEAS AND FEEDBACK

• NETATMO appreciates your interest in the products and the company and understands that you may have comments and suggestions. However, NETATMO does not want you to, and you should not, send any confidential or proprietary information to NETATMO through its Services, or through any other means. Please note that you have no confidentiality agreement with NETATMO and any unsolicited information or material sent to NETATMO will not be regarded by NETATMO as confidential or proprietary information. You may wish to consult with an attorney before making any unsolicited submission to NETATMO so that you can understand what will be the consequences of making an unsolicited public submission to NETATMO. If, however, you submit unsolicited information and feedback, including, without limitation, ideas for new advertising campaign, new promotions, new or improved products or technologies, product enhancements, processes, materials, marketing plans or new product names (collectively, the 'Feedback'), please be aware that regardless of what your letter and/or any other accompanying documentation may say, you are agreeing that the following terms shall apply to your Feedback: (1) NETATMO, and our designees, may use or redistribute the Feedback and/or any portions thereof for any purpose, including commercial purposes, and in any way; without compensation to you; (2) there is no obligation for NETATMO to review the Feedback and/or provide you with any commentary regarding the same; and (3) there is no obligation to keep any Feedback confidential.
• Upon submitting Feedback you (1) warrant that you are the original developer and/or creator of the Feedback and are legally free to make such a disclosure and you shall be solely liable for any damages arising from your submission of any information that is protected through copyright, trade secret law, patent law or other proprietary rights and (2) understand our feedback policy as set forth in this Section and accept this policy without reservation.

SUBMISSIONS POLICY

The Submissions posted on the Site by users do not indicate any approval or endorsement by NETATMO of such Submissions. NETATMO is not responsible for, and hereby disclaims any and all liabilities that may arise from the Submissions.
• You agree that you are responsible for your own use of the Services, for any Submission you make, and for any consequences thereof. INDEMNIFICATION OF NETATMO

Upon simple request by us, you agree to defend, indemnify, and protect NETATMO from and against any losses, liabilities, damages and costs, including without limitation, reasonable legal and accounting costs, arising or resulting from any claims, actions or demands related to (i) your use or misuse of the Services, including any UGC ; (ii) your breach of these Terms of Use ; or (iii) any breach of any intellectual property or other third party rights, or any applicable law in connection with the use of the Services. NETATMO shall provide a notice to you of any such claim, suit, or proceedings. NETATMO reserves the right to assume the exclusive defense and control of any matter which is subject to indemnification under this section. In such case, you agree to cooperate with any reasonable requests assisting NETATMO's defense of such matter.

TERMINATION OF THE SERVICES

• These Terms of Use will continue to apply until terminated by either you or NETATMO as set out below.
• If you want to terminate your legal agreement with NETATMO, you may do so by (a) notifying NETATMO at any time at the following address NETATMO, 245 Rue du Vieux Pont de Sèvres, 92100 Boulogne-Billancourt or by email: privacy@netatmo.com and (b) closing your accounts for the Services which you use.
• NETATMO may, at any time, terminate its legal agreement with you if:
  • You have breached any provisions of these Terms of Use (or have acted in a manner which clearly shows that you do not intend to, or are unable to comply with the provisions of the Terms of Use); or
  • NETATMO is required to do so by law (for example, where the provision of the Services to you is, or becomes, unlawful); or
  • The relationship between NETATMO and the Partner with whom NETATMO offered the Services to you has been terminated or the Partner has decided not to offer the Services anymore; or
  • NETATMO is transitioning to no longer providing the Services to users in the country in which you are a resident or from where you use the Services, for example in NETATMO's sole opinion, a service is no longer commercially viable.
• You understand and agree that some of your UGC, such as that displayed outside your profile, in any part of the Site, or on any social platforms, may continue to appear on the Site or on other social platforms even after your UGC is removed from the Site or your account is terminated.
• Sections 2 (Use of the Services), 7 (Disclaimer of Content and Warranties), 8 (Limitation of Liability), 9 (Indemnification of NETATMO), 10 (Termination of Terms of Use), and 13 (Miscellaneous) shall survive the termination of this Terms of Use.

USER MUST COMPLY WITH APPLICABLE LAWS

• The Services are hosted in the following countries: France, Ireland, Germany, The Netherlands, The United States, Japan and for Russian users, cloud hosting servers in Russia. If you access the Content or Services from inside or outside of France, you do so at your own risk.
• France and other countries control the export of certain products and information. You expressly agree to comply with such restrictions and not to export or re-export any of the Content to countries or persons prohibited under the export control laws. By downloading the Content, you are expressly agreeing that you are not in a country where such export is prohibited or are a person or entity for which such export is prohibited. You shall be liable for compliance with the laws regarding the import, export, or re-export of the Content.

• If any provision of these Terms of Use is found to be invalid by any court having competent jurisdiction, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect.
• NETATMO not applying any provisions of these Terms of Use is not construing as a waiver of that provision or any other provision in these Terms of Use.
• Except as expressly agreed by NETATMO and you, these Terms of Use constitutes the entire Terms of Use between you and NETATMO with respect to the subject matter, and supersedes all previous agreements, whether written or oral, between the you and NETATMO with respect to the subject matter.
• The section headings are provided merely for convenience and shall not be given any legal import.
• These Terms of Use will inure to the benefit of our successors, assigns, licensees, and sublicensees.
• Any information submitted or provided by you might be publicly accessible. Important and private information should be protected by you. NETATMO is not liable for protection of privacy of electronic mail or other information transferred through the Internet or any other network that you may use.

TERMS AND CONDITIONS OF USE OF THE NETATMO FORUM

By using the Netatmo Forum (the "Forum"), you agree to comply with and be bound by these Terms and Conditions of Use.
These Terms and Conditions and the Privacy Policy, available at https://www.netatmo.com (the “Privacy Policy”) are the basis for your access to and use of the Services. Please READ THEM CAREFULLY.

FORUM ACCESS

The Forum is a platform provided and hosted by Zendesk. It is open to anyone over the age of 18 who wishes to view the content posted by its users.
The use of our Services by minors is prohibited, unless authorised by a parent or guardian. By registering, accessing and using our Services, you acknowledge that the information provided, including information relating to your age or the consent of a parent or guardian, is true and complete.
In order to participate and post content on the Forum, you must have created and logged in with a Legrand - Netatmo - Bticino account.

REGISTRATION AND ACCOUNT CREATION

In order to create an account on the Forum, you must provide accurate and complete registration information:

• a functional personal email address, which will be used to confirm the creation of your account,
• a password that complies with current security standards.

You can define an Alias (public pseudonym) in your account settings, which will appear on every message you post and will therefore be visible to everyone.
You are solely responsible for any activity that occurs in relation to your account and must ensure that your password is kept confidential. You agree to immediately notify Netatmo of any unauthorised use of your account.

USER CONDUCT

The Netatmo Forum is open to everyone. While debates, discussions, votes and other interactions in the Forum are welcome, certain basic rules of courtesy and use are expected. The creation of this code of conduct reflects Netatmo's commitment to make this space a place of friendly discussions for all, while ensuring the quality of the debates and avoiding contributions that could harm the conversations. Comments and posts left on this Forum are moderated after the fact.
By using the Forum, you agree to follow these rules:

• Be polite and take part in the Forum in a spirit of friendliness and understanding.
• Do not use the Forum to post illegal, insulting, threatening or defamatory content, or incitement to commit a crime or offence.
• Do not impersonate any person or entity, or falsely claim affiliation with any person or entity.
• Do not use the Forum for spamming, advertising a product or service, or any other illegal activity.
• Do not engage in any activity that might interfere with the smooth running of the Forum.
• The following will be immediately removed:
  • Attacks or insinuations based on beliefs or lack of beliefs, ethnicity, gender or sexual orientation, or political opinions,

You also hereby agree not to:

• carry out any activities that impose an unreasonable load on the infrastructure of the platform hosting the forum,
• use any device, software or program to interfere or attempt to interfere with the proper functioning of the Forum or any activity conducted on the Forum,
• delete or modify information posted on the Forum by NETATMO or by any person or entity,

CONDUCT OF THE NETATMO TEAM

The Forum was created to enable users to connect with the community of Netatmo product users and exchange views and opinions with each other. The Netatmo team is not obliged to reply to every message or request.

OWNERSHIP OF CONTENT

You remain the owner of any content that you post on the Forum. You grant the Forum a free, non-exclusive licence to use, copy, distribute and display your content on the Forum.
You hereby agree not to post any content on the Forum that infringes the rights of third parties, in particular those relating to image, privacy, data protection, copyright, trademarks, patents or trade secrets. You also agree not to use the Forum to encourage or facilitate any infringement of these rights. If you post content on the Forum, you warrant that you are the owner of the content or that you have obtained all necessary permissions from the owner to post the content on the Forum.

CONTENT MODERATION

The team of moderators is authorised to edit, move or delete posts in order to comply with the rules of use of the Forum set out in particular in Article 4.
Netatmo reserves the right to remove any content that violates these Terms and Conditions of Use or that Netatmo deems inappropriate, without notice or liability to you.
Lastly, Netatmo reserves the right to permanently ban users who violate these General Terms and Conditions of Use in the event of a seriously inappropriate post or a repeat offence following a warning. As this ban is tied to the email address of the account concerned, it will be effective for both the Forum and requests sent via the Help Center.

WAIVER OF WARRANTIES

Netatmo does not warrant that the Forum and the content contained therein will be available without error or on an uninterrupted basis, and the Forum makes no express or implied warranty regarding the content or the Forum itself.

LIMITATION OF LIABILITY

To the maximum extent permitted by law, Netatmo and its affiliates, employees, agents and licensors will not be held liable for any damages arising from or related to your use of the Forum. In no event will Netatmo be liable for any indirect, incidental, punitive or consequential damages (including, without limited to, damages for loss of profits, loss of data or business interruption) arising out of the use, inability to use, or the results of use of the Forum and its content.
Netatmo cannot be held responsible for the veracity, accuracy and completeness of the content of the Forum. You hereby acknowledge that use of the Forum and its content is at your own risk.
Subject to the applicable legal provisions, Netatmo's aggregate liability, whether taken individually or collectively, arising out of the use of the website or its content (regardless of the form of action or claim, e.g., contract, warranty, tort, strict liability, negligence, or any other legal theory) is limited to £100.
Some countries do not recognise all the aforementioned limitations or exclusions, in which case they will not apply to you. IN SUCH COUNTRIES, NETATMO'S LIABILITY SHALL BE LIMITED TO THE GREATEST EXTENT PERMITTED BY APPLICABLE LAW.

COMPENSATION

You agree to indemnify and hold Netatmo and its affiliates, officers and employees harmless from any claim or demand, made by any third party due to or arising out of your use of the Forum or your breach of these General Terms and Conditions of Use.

CHANGES TO THE TERMS AND CONDITIONS OF USE

Netatmo reserves the right to modify these Terms and Conditions of Use at any time without notice or liability. Your continued use of the Forum following the release of any changes to these Terms and Conditions of Use constitutes your acceptance of those changes.

APPLICABLE LAW AND JURISDICTION

Subject to applicable mandatory provisions, these Terms and Conditions of Use are governed by and construed in accordance with French law. Any dispute shall be subject to the sole jurisdiction of the competent French courts.

PERSONAL DATA

The collection and processing of Personal Data, undertaken when you use the Services, is carried out in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (“General Data Protection Regulation” or “GDPR”).
